Due to a decision in the House of Lords you are now liable for any damage or injury that your horse
does to other people regardless of whether you are negligent or not. So make sure you have
third party liability insurance cover if nothing else.
In the case of Mirvahedy v Henley, the House of Lords decided that in the event of someone being injured by a horse,
the Animal Act should apply. Under the Animal Act the keeper/owner is strictly liable for any damage or injury to a
third party, whether negligent or not.
Prior to this case owners could rely on taking due care of their animals with good stable practice and management to
avoid the accusation of negligence. This is no longer a defence and the owner/keeper is liable regardless.
This decision is naturally leading to increased premiums for equine liability cover. However the cost of equine
liability insurance is still reasonable when considered against the costs of having to defend a third party
liability claim against yourself and the possible resulting compensation bill. |

This policy covers horse insurance.
The policy is a 12-month contract and renewal will be invited each year.
Statement of demands and needs
This policy is underwritten by Allianz Insurance plc and meets the needs of those wishing to insure a horse for death, theft,
vets fees, third party liability and personal accident for the rider. You will receive no advice or any recommendation from
us in relation to this product against other products. You will have to decide for yourself whether the insurance policy
offered is suitable for you.
Cancellation Rights
This contract gives you a cooling off period. If after receiving your certificate of insurance and full policy terms and
conditions you are not happy you have 14 days during which you can cancel the policy by sending written confirmation to
Stoneways, PO Box 135, Godalming GU7 1WZ. If you cancel outside of the 14 day cancellation period and the premium becomes due
you may not receive a return of your premium.
Claims Notification
You need to complete a claim form for the incident in question. You can notify us of a claim and obtain a claim form by
calling 01483 426966. Your vet may charge you a fee for completing a claim form; your policy does not cover this cost.

If Stoneways are unable to resolve the problem within 4 weeks your complaint will be passed to Allianz Insurance plc.
If we are unable to resolve the problem we will provide you with information about the Financial Ombudsman Service.

Financial Services Compensation Scheme
Allianz Insurance plc is covered by the Financial Services Compensation Scheme (FSCS).
You may be entitled to compensation from the FSCS if Allianz Insurance plc cannot meet their liabilities. You may be entitled to
compensation up to £2,000 for the first part of any claim and 90% of the remainder.

Significant Exclusions and Limitations (references in brackets are to the relevant sections in the policy terms and conditions)
- You must take proper care of your horse including an annual dental examination, vaccinations, worming programme and any treatment recommended by your vet to prevent illness or injury (General Condition 4a )
- Your policy does not cover any illness or injury that occurred before your cover started or any illness within the first 14 days of cover (General exclusion 4 and General Condition 1).
- You must be a resident of the United Kingdom (including the Isle of Man and the Channel Islands) to insure your horse under this policy (The Policy preamble).
- You pay the first: £85 on Death cover (Section A exclusion 2); £85 theft and straying (Section B exclusion 1); £125 for Standard Vet's Fees (Section C Exclusion 3); £85 Permanent loss of use (Section D exclusion 4); £50 for overseas transport (Section E Animals based on Islands); £85 on Trailers (Section G exclusion f); £85 on Saddlery & Tack (section H exclusion c); £250 on claims under Third Party Liability (damage to property only) (Section I exclusion 8).
- Your policy does not cover costs charged by your vet for completion of insurance claim forms or for the provision of any other information (General condition 6b).
Significant Features and Benefits
- Death from injury or illness: pays the sum insured or market value whichever is less following loss by death or euthanasia.
- Theft or straying: pays the sum insured or market value whichever is less following theft or straying.
- Vet's Fees: pays towards the cost of illness or injury by your attending vet. The limit will be shown on your certificate.
- Permanent Loss of Use: this is a condition caused by accident or illness occurring during the policy period which renders the animal permanently incapable of fulfilling all the uses for which it is insured. The policy pays either 75% or 100% of the sum insured (please refer to your certificate) or market value whichever is less. In the event of a claim the insured has the option, subject to the approval of insurers, of retaining the ownership of the animal, in which case the maximum indemnity shall be reduced to 60% of the sum insured or market value if less.
- Vets fees extension: Pays for non-veterinary costs incurred during a claim, the limit is shown on your certificate.
- Personal Accident and Dental: Covers permanent disability and loss of sight or limb and dental treatment up to limits shown in the certificate and policy wording.
- Trailer / Horse drawn vehicle: pays up to the sum insured or market value whichever the less.
- Saddlery & Tack: pays up to the sum insured or market value whichever the less.
- Third Party Liability: Pays for compensation for damage done by your horse to people or property for which you are found legally liable subject to £2 million limit. Cover includes costs and expenses incurred in defending a claim subject to insurers written approval.
